It ain’t what you say – noise-induced hearing loss

In a claim for noise-induced hearing loss (NIHL), a claimant described his work as involving ‘beating concrete with a Kango’.

The parties instructed Finch acoustic engineering expert Timothy Ward to advise on noise exposure and liability.

Whilst the description was accurate, Tim was able, from his knowledge of industrial processes, to advise the Court in further detail; rather than, breaking up concrete with a demolition hammer or similar, the work was likely to have been a quite different process of packing semi-dry, cement-aggregate mix into moulds using a hand-held powered tamping tool.

Having measured similar work in the past, Tim was able to advise on the likely noise exposure even in the absence of relevant disclosure, and the appropriate precautionary measures.
